Kullanım Koşulları

Kısaca: Tandem'i Lucy Goods LLC geliştirir. Ödemeler, kayıtlı satıcımız (Merchant of Record) olan Lemon Squeezy üzerinden alınır. Satın aldığın şey yazılımın mülkiyeti değil, kişisel kullanım lisansıdır. Tandem telefonun ile Mac'in arasında yerel olarak çalışır; mesajlarının, aramalarının ve ekranının içeriğini görmeyiz.

1. Taraflar

Bu koşullar, Lucy Goods LLC ("biz", "Lucy Goods") ile Tandem yazılımını indiren, kuran veya kullanan kişi ("sen", "kullanıcı") arasındaki sözleşmedir.

2. Tandem nedir

Tandem, bir macOS uygulaması ve bir Android uygulamasından oluşur. İkisi birlikte kurulduğunda telefonunu Mac'inden kullanmanı sağlar: arama yapma/cevaplama, mesajlaşma, kişiler, dosya aktarımı ve ekran yansıtma. Tek başına bir tarafla çalışmaz.

macOS uygulaması Apple Developer ID ile imzalanıp notarize edilmiş olarak doğrudan sitemizden dağıtılır (Mac App Store üzerinden değil). Android uygulaması APK olarak sitemizden dağıtılır (Google Play üzerinden değil). Kurulum, cihazının işletim sistemi ayarlarına bağlıdır ve sorumluluğu sana aittir.

3. Lisans

Ödemen alındığında sana kişisel, devredilemez, münhasır olmayan bir kullanım lisansı veririz. Yazılımın telif hakkı ve tüm fikri mülkiyeti Lucy Goods LLC'de kalır.

Yapamayacakların: yazılımı yeniden satmak, kiralamak, dağıtmak; kaynak koda dönüştürmek (yürürlükteki yasanın açıkça izin verdiği haller dışında); lisans/etkinleştirme mekanizmasını atlatmak; başkalarının hesabıyla kullanmak.

Lisans, hesabına bağlıdır ve makul sayıda kendi cihazında kullanılabilir. Kötüye kullanım (ör. lisans paylaşımı) tespit edilirse lisansı askıya alabiliriz.

4. Hesap

İndirme ve lisans için Google hesabınla giriş yaparsın. Hesabının güvenliğinden sen sorumlusun. Verdiğin bilgilerin doğru olması gerekir. Bu koşulları ihlal eden hesapları askıya alma veya kapatma hakkımız saklıdır.

5. Ücretler ve ödeme

Tandem ücretsiz indirilir; ücretli özellikler lisans satın alınarak açılır. Geçerli fiyat, para birimi ve varsa vergiler ödeme ekranında gösterilir.

Ödemeler Lemon Squeezy (Lemon Squeezy LLC) tarafından işlenir. Lemon Squeezy bu satışta kayıtlı satıcıdır (Merchant of Record): faturayı o düzenler, satış vergisi/KDV yükümlülüklerini o yönetir ve ödeme yöntemi bilgilerini o işler. Ödeme sırasında Lemon Squeezy'nin kendi koşulları ve gizlilik politikası da geçerlidir. Kart bilgilerini biz görmeyiz ve saklamayız.

Abonelikler

6. İade

İade şartları ayrı bir sayfada açıklanmıştır: İade Politikası. Bu koşulların ayrılmaz parçasıdır.

7. Kabul edilebilir kullanım

Tandem'i yasalara aykırı şekilde, başkalarının iletişimini rızası olmadan izlemek/kaydetmek için veya üçüncü kişilerin haklarını ihlal edecek biçimde kullanamazsın. Yansıttığın veya aktardığın içerikten yalnızca sen sorumlusun.

8. Güncellemeler ve hizmet değişiklikleri

Yazılımı güncelleyebilir, özellik ekleyebilir veya kaldırabiliriz. Ücretli bir özelliği tamamen kaldırırsak ve bu abonelik dönemini esaslı biçimde etkilerse, makul bir çözüm (kalan dönem için orantılı iade gibi) sunarız.

Tandem üçüncü taraf platformlara (macOS, Android, cihaz üreticisi kısıtları) bağlıdır. Bu platformların yaptığı değişiklikler bazı özellikleri etkileyebilir veya sona erdirebilir.

9. Garanti reddi

Tandem "olduğu gibi" sunulur. Yürürlükteki yasanın izin verdiği ölçüde, kesintisiz veya hatasız çalışacağına dair açık ya da zımni garanti vermiyoruz. Tüketici olarak yasadan doğan hakların bu maddeden etkilenmez.

10. Sorumluluğun sınırı

Yürürlükteki yasanın izin verdiği ölçüde, dolaylı zararlardan (veri kaybı, kâr kaybı, iş kesintisi) sorumlu değiliz. Toplam sorumluluğumuz, talebin doğduğu tarihten önceki 12 ay içinde Tandem için bize ödediğin tutarla sınırlıdır. Kasıt, ağır ihmal ve yasanın sınırlanmasına izin vermediği haller saklıdır.

11. Fesih

Yazılımı silerek kullanımı istediğin zaman bırakabilirsin. Bu koşulları esaslı şekilde ihlal edersen lisansını feshedebiliriz; bu durumda yazılımı kullanmayı bırakman gerekir.

12. Değişiklikler

Bu koşulları güncelleyebiliriz. Esaslı değişiklikleri e-posta ile veya uygulama içinde bildiririz. Bildirimden sonra kullanmaya devam etmen, yeni koşulları kabul ettiğin anlamına gelir.

13. Uygulanacak hukuk

Bu koşullara Florida, ABD hukuku uygulanır; uyuşmazlıklarda Florida mahkemeleri yetkilidir. Tüketicinin, yaşadığı ülkenin zorunlu tüketici koruma hükümlerinden doğan hakları saklıdır.

In short: Tandem is made by Lucy Goods LLC. Payments are processed by Lemon Squeezy, our Merchant of Record. You are buying a personal licence to use the software, not ownership of it. Tandem works locally between your phone and your Mac — we do not see the content of your messages, calls or screen.

1. Who we are

These terms form an agreement between Lucy Goods LLC ("we", "us") and the person who downloads, installs or uses Tandem ("you").

2. What Tandem is

Tandem consists of a macOS app and an Android app. Installed together, they let you use your phone from your Mac: place and answer calls, send messages, access contacts, transfer files and mirror your screen. It does not work with only one side installed.

The macOS app is signed with an Apple Developer ID, notarized, and distributed directly from our website (not via the Mac App Store). The Android app is distributed from our website as an APK (not via Google Play). Installation depends on your device's operating system settings and is your responsibility.

3. Licence

Once your payment is received we grant you a personal, non-transferable, non-exclusive licence to use the software. Copyright and all intellectual property remain with Lucy Goods LLC.

You may not resell, rent or redistribute the software; reverse engineer it (except where the law expressly allows); circumvent the licensing or activation mechanism; or use someone else's account.

The licence is tied to your account and may be used on a reasonable number of your own devices. We may suspend a licence if we detect abuse (for example licence sharing).

4. Account

You sign in with your Google account to download and to hold a licence. You are responsible for keeping your account secure and for the accuracy of the information you provide. We may suspend or close accounts that breach these terms.

5. Fees and payment

Tandem is free to download; paid features are unlocked by purchasing a licence. The applicable price, currency and any taxes are shown at checkout.

Payments are processed by Lemon Squeezy (Lemon Squeezy LLC), who acts as Merchant of Record for the sale: they issue the invoice, handle sales tax/VAT obligations and process payment details. Lemon Squeezy's own terms and privacy policy also apply at checkout. We never see or store your card details.

6. Refunds

Refund terms are set out separately in our Refund Policy, which forms part of these terms.

7. Acceptable use

You may not use Tandem unlawfully, to monitor or record someone else's communications without their consent, or in any way that infringes third-party rights. You alone are responsible for the content you mirror or transfer.

8. Updates and changes to the service

We may update the software and add or remove features. If we remove a paid feature entirely and this materially affects your subscription period, we will offer a reasonable remedy (such as a pro-rata refund for the remaining period).

Tandem depends on third-party platforms (macOS, Android, device manufacturer restrictions). Changes made by those platforms may affect or end certain features.

9. Disclaimer of warranties

Tandem is provided "as is". To the extent permitted by law, we make no express or implied warranty that it will run uninterrupted or error-free. Your statutory consumer rights are not affected by this clause.

10. Limitation of liability

To the extent permitted by law, we are not liable for indirect losses (loss of data, loss of profit, business interruption). Our total liability is limited to the amount you paid us for Tandem in the 12 months before the claim arose. Nothing limits liability for wilful misconduct, gross negligence, or anything the law does not allow to be limited.

11. Termination

You may stop using the software at any time by deleting it. We may terminate your licence if you materially breach these terms, in which case you must stop using the software.

12. Changes to these terms

We may update these terms. We will notify you of material changes by email or in the app. Continuing to use Tandem after notice means you accept the updated terms.

13. Governing law

These terms are governed by the laws of the State of Florida, USA, and disputes are subject to the courts of Florida. Mandatory consumer protection rights in your country of residence are unaffected.
